The company has been zealous about protecting its trademarks, trade secrets and other assets; since 1996, the company has filed 20 suits against other manufacturers, individuals, retailers or others over issues connected to the nation's $7.6 billion-a-year mattress industry, the docket at the federal courthouse in Minneapolis shows.
For example, in April 2006, after officials with rival mattress maker Serta Inc. wrote to Select Comfort to complain about the company's use of the phrases 'The Key to a Perfect Night's Sleep' and 'The Gift of Perfect Sleep,' Select Comfort sued Serta. The company sought a declaratory judgment that the phrases did not infringe on Serta's phrases 'Perfect Sleeper' and 'Perfect Night.'
That case was settled out of court in March.

It was great. Best night's sleep I'd had in years. And then, just as I was sure I'd found my Morpheus-sent Nirvana, I found the mattress developing a definite slump in the middle.
